Do I need a permit for a fence in Montgomery County?

YES! All fencing, residential or commercial, in the County requires a permit obtained through Montgomery County’s Department of Permitting Services. If replacing an existing fence, the replacement fence does not require a permit as long as the original fence was installed under a permit. Some tips that might help you in the process are included below. . .

  1. The County requires a plat/survey of your property provided by a licensed surveyor on which to show the proposed fencing. No other drawing will be accepted. Don’t have a plat? Check to see if the County has it on file. Submit a records request on their website.
  2. Various easements controlled by the County or utility companies can prohibit the installation of a fence on your property. Check your plat for lines that cut across your property and are labeled with words like “Storm Drain Easement”, “San/Sewer Easement”, “P.U.E”.
  3. The DPS system processes permits using an all online system. the link to the application can be found here. Create an account to begin the process.
  4. Some areas in Montgomery County require TWO permits. . . one from your municipality and one from the County. Cities/towns like this include Chevy Chase, Takoma Park, and Laytonsville. On the flip side, Gaithersburg and Rockville have their own permitting requirements within their jurisdiction. No County permit is required if you are located within one of these two Cities.
